Acceptable Use Policy/User Agreement

This document is an electronic record in terms of Information Technology Act, 2000 and rules made there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and user agreement for access or usage of website.

Your use of (hereinafter referred to as "Website") and its related sites, services and tools shall be governed by the following terms and conditions as contained in this User Agreement/Acceptable Use policy (hereinafter referred to as "AUP") entered into between KOONK TECHNOLOGIES PRIVATE LIMITED, a company owning and operating the Website, incorporated under the Companies Act, 1956 having its registered office address at c/o P. Pinacha, 108,1st Floor, Shree Mansion, G-23, Kamla Nagar, Behind Rajdhani Hospital, C-Scheme, Jaipur - 302001, Rajasthan, India (hereinafter referred to as "Company"), and you, and your assigns, employees, agents or contractors ("You", "Your", the "Client").

The use of the Website together with the services is offered to you conditioned on your 'Acceptance' of all the terms, conditions and notices contained in this AUP. Upon Acceptance, this AUP shall be effective and binding upon you along with any amendments made by the Company at its sole discretion and posted on the Website and you shall not claim invalidity of this AUP merely on the grounds that this AUP is concluded electronically. For the aforesaid purposes, "Acceptance" shall mean any affirmative action on your part or any act which reflects your use of the Website or the services provided by the Website or any such other actions that implies your acceptance. You hereby further agree that this AUP is being concluded and executed at New Delhi.

For the purpose of this AUP, User, Clientand wherever the context so require '"you", "your" shall mean any natural or legal person, who himself or on others behalf is accessing the Website or any servers of, its contents and using the services offered on or through the Website or has agreed to become a member of the Website through registration using the computer systems of the Website and accepted this electronic version / electronic record of the AUP or has allocated a unique identification user name ("User ID" and "Password") to become registered User or have been identified as guest User (as the case may be). Further, reference to "we", "us", "our" and "" shall mean Koonk Technologies Private Limited and includes its assigns, associates, affiliates and subsidiary(ies), employees, agents or contactors.


  1. In terms of Information Technology (Intermediaries Guidelines) Rules, 2011 you agree and undertake that the below mentioned activities shall not be performed by you on the Website or any of our dedicated servers. We also reserve the right to make addition, deletion or any other modification to the list without prior notice: upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;

  1. administer IRC, gameservers;

  1. provide web proxying or other anonymizing services to hide the origin of network traffic;

  1. harm minors in any way;

  1. impersonate any person or entity;

  1. "stalk" or otherwise harass another person;

  1. forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Services;

  1. upload, post, email, transmit or otherwise make available any Content that You do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under non-disclosure agreements);

  1. upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;

  1. upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," or "pyramid schemes;"

  1. upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

  1. interfere with or disrupt the services or servers or networks connected to the services, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;

  1. upload, post, email, transmit or otherwise make available any material that threatens the unity, integrity, defense, security or sovereignty of India or any other nation, friendly relations between foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation;

  1. intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the Indian Government, any rules of any national or other securities exchange, including, without limitation, the National Stock Exchange, the American Stock Exchange or the NASDAQ, or any other stock exchange and any regulations having the force of law;

  1. provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the Indian government as a foreign terrorist organization; and/or

  1. collect or store personal data about other users in connection with the prohibited conduct and activities set forth in the paragraphs above.

  1. Breach

Without limiting other remedies, we may limit your activity, immediately remove your information or end your services, warn other Users of your actions, temporarily/indefinitely suspend or terminate or block your registration/membership, and/or refuse to provide you with access to the Website in the event, but not limited to:

  1. If you breach this AUP or Privacy Policy or Terms of Service or the documents, agreements, rules, policies, terms and conditions as posted on the Website;

  1. If we are unable to verify or authenticate any information provided by you; or

  1. If it is believed that your actions may cause legal liability for We may at any time at our sole discretion reinstate suspended Users. A User that has been suspended or blocked may not register or attempt to register with or use the Website or any of its services in any manner whatsoever until such time that such User is reinstated by Notwithstanding the foregoing, if you breach this AUP or any other documents as posted on the Website, reserves the right to recover any amounts due and owing by you to us and to take strict legal action including but not limited to a referral to the appropriate police or other authorities for initiating criminal or other proceedings against you.

  1. Liability in respect of violations: shall not bear any responsibility or liability in respect of any loss or damage arising out of the prohibited activity stated above or as amended from time to time.

In no event shall or its assigns, associates, employees, affiliates and service providers be liable for any direct, indirect, incidental, special, incidental, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses arising out of or in connection with the Website, its services or this AUP (however arising, including negligence).


You agree to indemnify and hold harmless and (as applicable)'s parent, subsidiaries, affiliates, third-parties and their respective shareholders, officers, directors, agents, and employees, from any losses, liabilities, damages, costs and expenses, claims or demand, or actions including reasonable attorneys' fees asserted against or incurred by, made by any third party arising out of your breach or non-performance of terms of the AUP, Terms of Service, Privacy Policy or the documents as posted on the Website, or your violation of any law, rules or regulations or the rights of a third party.


We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent and we only use your information as described in the Privacy Policy. We view protection of Users' privacy as a very important community principle. We understand clearly that you and your personal information is one of our most important assets. We store and process your information with reasonable technological security measures and procedures in accordance with Information Technology Act 2000 and rules there under. Your Consent: By using the Website and/ or by providing your information, you consent to the collection and use of the information you disclose on the Website by in accordance with Privacy Policy. You agree and acknowledge that you have read and fully understood the Privacy Policy and the terms and contents of such Privacy Policy as mentioned in the Website is acceptable to you.


We reserve the right to amend, alter, or modify this AUP at any time in our sole discretion. You are responsible for all use of the services or by your employees, agents, contractors, invitees and customers, whether such use is with or without your consent. Any amendment or modification to this AUP is effective when posted and your continued use of the Website or the services after the posting of a modification or amendment will be considered as your acceptance of those modifications.


This AUP or the documents it incorporates by reference shall be governed and construed in accordance with the laws of India. All disputes arising under this AUP between you and shall be subject to the exclusive jurisdiction of courts at New Delhi, India.
